(1) Terms and conditions for Classroom Training
In these Terms and Conditions, “we”, “us” or “our” means Balance Global “you” means the person or business that purchases delegate places on a Classroom 3 day or 5 day with us being held at various locations, as set out in the e-mail confirmation from us after you have paid requisite fees. By completing and submitting the electronic order form (or proceeding through the ‘checkout process’) & or by speaking to a Balance Global representative you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Neither submitting an electronic order form nor completing the checkout process constitutes our acceptance of your order. For avoidance of doubt, all bookings are subject to availability.
Each of these Terms and Conditions shall be read and construed independently of each other so that if one or more is held to be invalid for any reason whatsoever, then the remaining Terms and Conditions shall be valid. Further, if any Term or Condition is found to be void, but would be valid if some part of it were deleted, then such Term or Condition shall apply with such modification as may be necessary to make it valid and effective. We shall not be responsible for any failure to perform our obligations due to circumstances beyond our control. These Terms and Conditions are governed by English law and the Courts of England will have exclusive jurisdiction.
Each Classroom will aim to have between 12 and 16 delegates. The Classroom is blended approach to learning which combines pre-course materials and Classroom. Each delegate would be allocated pre-course courseware and Classroom whereby delegate will have classroom session with a fully qualified and experienced coach. Please note that when the courseware is PRINCE2®, each delegate is required to complete pre-course before attending the Classroom.
We reserve the right to cancel or re-schedule any Classroom. Please note that we cannot reimburse any costs incurred due to cancellation of the workshop (for e.g. travel, hotel etc.). We will endeavour to inform delegates of cancellation / re-scheduling at least 2 weeks before the original date of the workshop.
(2) Prices
All prices published exclude value added tax (VAT). VAT is payable, The VAT rate is set based on the location of the course. The published prices do not include any travel, accommodation or living expenses. All pricing quotations are valid only for 7 days from the date they are first sent.
(3) Payments
The course fees, including VAT, are payable 20 working days before the course start date. Payments can be made by major credit and debit cards, Bank transfers (bacs) or via company cheques and PayPAl. We reserve the right to hold all services until payment is received in full.
Where a Purchase Order is issued, it must clearly state the purchase order number, course dates, full Invoice amount and contact details for invoicing. When more than one course is booked on the same purchase order, full payment for all courses, including VAT, is required 20 working days before the commencement of the first course.
Where the relevant invoice has not been paid by the course start date, then we have the right to refuse the delegate(s) entry to the course. In these circumstances, the invoice in question will remain payable in full. We reserve the right to withhold examination results and certificates until all payments have been received.
The terms of this agreement override over any other terms of business or purchase conditions put forward by the Customer.
(4) Deposit/Part Payments
All deposits/part payments are non-refundable, if the intended course is within the 20 working days of the of the course start date.
By presenting a Purchase Order, Placing Order online or over the Phone you are requesting services from us.
(5) Purchase Order/identification number
If a purchase order is provided there is no need for any other confirmation. The purchase order constitutes as a legal offer to buy products or services. The Purchase Order is deemed as a confirmation of an order and is bound by the cancellation & re-scheduling policy set out.
(6) Refunds and Cancellation of website orders:
All orders placed through the website are non-refundable.
Delegate Cancellation and/or Re-Booking Charges
In case you need to cancel and / or re-book the Classroom, then following charges apply:
20+ Days 20-15 Days 14-0 Days
£99+Vat 50% of the total course fee including Vat 100% of the course fee
In the unlikely event, you decide to cancel your purchase of a course, it can be done in following way:
By filling out Cancellation Form requested from support@balance-global.com
Should a course booking be made less than 20 working days in advance of the start date of the course, the above cancellation terms still apply.
Rescheduling courses less than 20 working days of the course start date is not permitted and therefore will incur a 100% rescheduling fee.
Rescheduling courses more than 20 working days of the course start date will incur a £99+VAT charge (per change) payable immediately upon rescheduling.
(7) Refunds
Please note that failure to attend the workshop will not be eligible for refund whatsoever. The above charges will apply.
In the case where a refund is made to you by us, the refund may take up to 14 working days to be processed. Refunds will be processed using the same payment method that the original payment was made.
(8) Re-scheduling or deferring of Practitioner Exams
Rescheduling or deferring practitioner exams is permitted and therefore will incur a £199+VAT rescheduling/deferring fee per exam per change. Rescheduling/deferring exams fee must be paid payable immediately upon rescheduling. Delegate must inform Balance Global 24 hours in advance of the original exam date.
- All examination voucher purchases are non-refundable.
- All classroom orders placed via the website are non-refundable.
Balance Global reserves the right to change any part of a published course; if this is caused by circumstances beyond our control. We reserve the right to cancel or reschedule any course and will advise the customer as soon as the change is known. We will use all reasonable endeavors to avoid changes of this nature. For any courses, which are rescheduled due to unforeseen circumstances such as trainer sickness/course low fill every endeavor will be made to provide a replacement trainer or to reschedule the course and we will offer delegates as many options as possible to complete their training programme.
The Location and course date of the course will be advised upon booking. We reserve the right to change the location and will advise the customer as soon as the change is known. We will not be liable for out of pocket expenses due to cancellation or any other changes to venue or programme.
(9) Non Attendance
Any Non-attendance of any course for any reason whatsoever is deemed to be a cancellation with no notice and payment is due in full.
(10) Course Selection
You accept that it is your responsibility that the course booked is suitable for your requirements and ability. We employ advisors who recommend courses or learning solutions, however, the assessment and the final decision concerning suitability of the course is your responsibility. In cases where we have made recommendations, we do so in good faith and not be wilfully misleading is based on the information you provide.
(11) Exclusions
We reserve the right to refuse admission to any person whom it considers in its absolute discretion to be unsuitable for whatsoever reason.
(12) Onsite Site
It is the Customer’s responsibility to provide all facilities, equipment and set up required for trainer to deliver the training. We reserve the right to cancel or discontinue the course if, in the Trainer’s opinion, the venue, equipment or conditions are unsuitable.
(13) Copyrights
All intellectual property rights for all course materials shall remain the property of Balance Global. The Customer agrees not to reproduce, sell, hire, lend or copy the course materials or use them except for the purpose of personal reference. Balance Global warrants that it will not knowingly include any copyright material in its course materials without license or consent.
(14) Warranty & Liability
Balance Globala liability for loss and damage shall be limited to a claim for damages. The maximum aggregate liability will be the charges for the course out of which the loss or damage has arisen. We will not accept liability for death or personal injury. We will not be liable for indirect, special or consequential loss (including loss of anticipated profit or data), howsoever arising, even if it has been advised of such potential loss. We will not be responsible for any damage resulting from any computer viruses arising from software installed on customer computer systems.
(15) Nomination of Alternative Delegate
Nomination by the client of an alternative delegate for a course may be made at any time up to the course start date. The fee for making this change is £150 per candidate substitution in order to cover administrative expenses. However, Balance Global cannot guarantee that this can be fully accommodated as there may be examination registration deadlines which are outside our control.
In all cases the customer undertakes to bring these terms and conditions to the attention of delegates. It is the customer’s responsibility to ensure that the delegate(s) receive all the relevant information including the joining instructions and that they meet the eligibility and published pre requisite requirements.
(16) Delegate Behavior
Balance Global expects delegates attending classroom based courses to behave in a polite and appropriate manner and reserves the right to exclude delegates or abandon the course in the event of disruptive, abusive or threatening behaviour by an individual or group of delegates. In such an event, no refund will be payable to the client of the excluded delegate.
(17) Personal Belongings
Personal belonging or items belonging to the delegate on the delegate brought onto training courses are the sole responsibility of the Delegate. Balance Global accepts no responsibility of the items or any loss or damage that may occur during the course.
(18) Accommodations for Persons with Disabilities
Balance Global welcomes participation by individuals with disabilities.
